On My Country's Criminal Trial By Default

In our country,the absence of criminal trial by default system for a long time not only causes great impact on the efficiency of litigation,but also makes the defendants who abscond abroad keep "clean body" in law for a long time,and to some extent,promotes the "escape style" of criminals.However,the establishment of criminal trial by default system just makes up for the above shortcomings.However,as a new system,it will inevitably have some problems at the beginning of formulation.In this regard,on the basis of fully defining the connotation of the criminal trial by default system,through the analysis of the legislative status of the system,we should point out and deeply study the problems and causes of the criminal trial by default system in China.At the same time,by comparing the mature experience of other countries on the system,the author finally puts forward some superficial opinions and suggestions for the improvement of the criminal trial by default system in China,including the improvement of the scope of application of the system,the provisions on service of documents,the improvement of the defendant’s rights protection procedure and the court’s retrial procedure.
