| The drug issue is a worldwide issue,and its governance is even more problematic.This article begins with a discussion of the drug problem and its governance.It is considered that drug addiction is a disease.Therefore,the simple and rude punishments of traditional criminal justice can not be taken when it comes to drug control.More and more,medical and psychology and sociology of treatments are to be used.However,the traditional criminal justice measures have its value and function of controlling the drug issue and can not be completely discarded.Therefore,the reform of the traditional criminal justice system on drug administration has led to the so-called "therapeutic punishment",which is the combination of treatment methods and the punishment approaches.The drug court is undoubtedly the manifestation of the concept of "therapeutic jurisprudence" in the judicial system reform.This article goes on to outline the background and characteristics of the Australian drug court.It believes that TJ is the ideological foundation that the Australian Drug Tribunal created,and that the practice of the U.S.Drug court is its institutional foundation.Since 1999,Australian states have basically established their own drug courts,which have both commonalities and respective characteristics.This paper analyzes in detail the operating mechanism of the Australian Drug court,which is elaborated from three aspects: before operation,during operation and after operation.The focus is on several procedures in operation,and the screening and assessment procedures during the reception phase are the prerequisites for smooth operation.The drug court panel is responsible for all aspects of the treatment plan,and the status hearing guarantees the interaction and active contact between the offender and the court.Drug testing is an essential feature of the drug court program.Drug treatment plays a decisive role in abstinence from drug addiction.When operating a treatment plan,the Australian drugs court generally designs the plan in three phases,each with its own purpose and the limitations and requirementsassociated with it.This article argues that the care given to criminals after completion of the program is very important for consolidating the results of the drug court treatment plan.The effectiveness of the drug court needs to be evaluated.This article will examine the impact of drug courts on drug abuse from four aspects: the impact of drug courts on criminality(recidivism),the impact of drug courts on the health and well-being of offenders,the cost of drug courts Efficiency.This paper argues that drug courts are positive for drug abusers to reduce the impact of drug abuse or drug abstinence;that drug courts also play a positive role in reducing the rate of re-criminals who succeed in completing planned programs;and drug courts improve the health and well-being of offenders;Drug courts also have high economic benefits.Of course,the drug court itself also faces some problems that need constant improvement in practice.Finally,this article argues that the biggest inspiration for the Australian drug court for our country lies in the treatment of drug addicted criminals.The penalties in our country emphasize the penalties for drug addicted criminals and ignore the effective treatment for them.Therefore,for drug addicted criminals,we should establish a reasonable diversion system to divert eligible drug addicted criminals to community treatment.At the same time,a drug court shall be set up in grass-roots courts and a drug court team shall be set up with judges as the core.The drug court team absorbs the treatment specialists and relevant staff of all parties and be responsible for trial and treatment management of drug addicted criminals.Drug addiction treatment for drug addicted criminals can link up with community drug detoxification and community rehabilitation mechanisms in our country.After the completion of the treatment phase,drug addicted criminals can be placed in a community correction system,therefore to form a drug addicted criminals treatment system with Chinese characteristics. |
