The Research Of The Civil Rights Of The Chinese Constitution

The relationship between civil rights and state power is a key issue in theconstitution.However, the status of civil rights and state power in the constitution are notequal.Modern natural law says that the state authority is derived from and transformedfrom the civil rights and civil rights is the foundation,source and the aim to run of the stateauthority. Therefore, civil rights is the core value and ultimate purpose of theConstitution.Since the Qing government promulgated the Outline Imperial Constitution in1996, the Constitution of our country has gone through nearly a century of vicissitudesmileage.After the founding of the people’s Republic of China, our government haspromulgated the four constitutions, namely the1954Constitution, the constitution of1975,the1978constitution and the current constitution of1982.Constitution is a windowthrough which people can understand the history and politics of an era. Through theunderstanding of citizens’fundamental rights of the Constitution, we can spy on theconservation status of the rights under the prevailing historical conditions at thattimes.Throughout centuries of practice, we can see that theory of rights is developingcontinuously; the subject of rights continues to expand; the rights content is increasing, andcomparing the contents of constitutional rights in terms of longitudinal, despite thecontents repeating, progress is the mainstream.Through horizontal comparison with outsidecountries, we can clearly find inadequate protection of the rights of citizens of the existingconstitution.We need pay more attention to the problem encountering in the process ofdevelopment to protect the core values of the Constitution.
