China has put forward the idea of building a "service-oriented" government, but the theory and practice is not yet mature. In this regard, Japan has been ahead of our country, and issued a Public Service Reform Act in2006, through which to guarantee the implementation of the reform of public services. The promulgation of Japan’s Public Service Reform Act, on one hand, has followed the new public management movement trend of the world; on the other hand, is achieved by the factors of severe domestic economic situation, rigid government dominant mode, aging of population, low birthrate and politicians’impetus and so on. Its legislative technology is advanced, informative and thoughtful. The basic content include the "general provisions","basic principles"," implementation program","legal case","Securities Commission" and so on. Its legislative purpose is mainly to market the public services through the introduction of competition mechanism to improve the quality of the public services as well as cut down the costs of public services. According to Japan’s Public Service Reform Act implementation procedures:First, the government should publicize the public service projects; then, the government and the private enterprise bid in a fair and just environment; finally, the winner gets the authority to implement the public service. By this way, Japan, to a certain extent, improved the quality of public services, cut the government costs, but at the same time, there have been many questions and controversies. Japan’s Public Service Reform Act undoubtedly provides reference value for service-oriented government of China’s legal construction.The promulgation of Japan’s Public Service Reform Act is inseparable from its mature market mechanism, high level of democratization and legalization, which China has not fully equipped yet. Therefore, our country should not copy the pattern of Japan, but should promote the construction of service-oriented government step by step. The valuable experience of legislation before reform is also worth us learning. Besides, we should pay attention to those problems that has caused after the implementation of Japan’s Public Service Reform Act in the construction of service-oriented government in the future.
