With the development of economic globalization and the advent of the knowledge-based economy, intellectual property is increasingly becoming the focus of international competition. Traditional Chinese medicine (TCM) in our country is rich in resources and knowledge superiority; therefore it is likely to become a pillar industry with completely independent intellectual property rights and the international competitiveness. With the concept of "return to nature", "green consumption", governments, enterprises and people around the world pay more attention to understand TCM, and natural medicines are growing. They provide the opportunity for the development of internationalization of TCM, but TCM industry also faces many challenges. As a result of the awareness of weak intellectual property protection, weak R&D and innovation, low value-added factors of TCM exports , they constraint and obstacle the process of internationalization of TCM industry, and intellectual property rights are the most outstanding problem. On one hand, the Study on intellectual property rights in the international development of TCM industry can provide more theoretical and practical guidance to help the related industries and enterprises and at the same time TCM get a better position in the pharmaceutical industry to maintain our country's traditional strengths, improve in the pharmaceutical industry's international competitiveness.First, it uses a combination of research methods, such as a combination of theoretical analysis and empirical analysis, comparative analysis. It first introduces the related concept of internationalization of the industry, the concept of intellectual property rights. Then, through the analysis of intellectual property rights on the international competitiveness and the important role of scientific and technological innovation, it expounds intellectual property protection on the impact of internationalization of the pharmaceutical industry. Based on the analysis of the international development of Japanese"Kampo medicines"and its intellectual property protection strategy, this thesis analyses the situation of international development of TCM industry, and further analyses the status and questions of intellectual property rights of TCM at three aspects including intellectual property development, operations management and the protection. And then this thesis makes use of the gray relational grade method to analyze the impact of intellectual property rights on international development of TCM industry from the perspective of empirical analysis. The result is that intellectual property rights play a catalytic role on the internationalization of TCM industry. Finally, according to the specific characteristics of TCM industry internationalization and the status and questions of intellectual property rights protection of TCM in our country, this thesis proposes to build strategic system of intellectual property at the intellectual property development, operations management and the protection aspects. This strategic system of intellectual property involves TCM basic environment, technology development, Chinese medicine talent, industrial alliances, independent brands, policies and measures. More practical implementation of strategic system of intellectual property protection will help improve the ability of innovation in the TCM industry, improve the international competitiveness of TCM industry, in order to expand the products in the world natural medicine market share.
