| Ecological civilization construction project is an indispensably constitutive part of Chinese Marxism.18th CPC National Congress has specifically proposed significant“five-in-one”strategies.Moreover,ecological civilization construction was firstly listed into national strategies.Russia,as a strong nation of ecological resource,has been putting great emphasis on ecological legal system research and legitimate practices of ecology.Russia and our nation have experienced almost same system reforms,which has strong relativity in both sides.So Russia's ecological legal system construction experiences will undoubtedly provide important support and inspirations for our nation's ecological civilization construction.In this paper,based on the experience of Russia,a comparative study on the theory and practice of the construction of ecological legal system in China and Russia is made and the idea to structure the path of ecological civilization construction in China from the aspects of ecological culture,public participation,legal system,ecological system and international cooperation is put forward.This paper consists of seven chapters.In the first chapter,the concept,regulating object,regulating method,development thread,basic principle of Russian ecological law and the relationship with other laws are mainly defined and the basic theoretical problem of Russian ecological law is clarified.In the second chapter,the centralized and unified ecological management system under the guidance of the Ministry of Natural Resources and Ecology of Russia is discussed and some countermeasures and suggestions on how to expand public participation in ecological management in China are put forward on the basis of studying the new trend of Russian ecological management system.In the third chapter,a review on the philosophical principle and connotation of Russian ecological culture construction is made and the proposal to incorporate ecological culture into Chinese legal system to reinforce the social basis of ecological rule of law is made.In the fourth chapter,the contents of Russian ecological legal system are summarized and evaluated and on the basis of the experience of Russia,the proposal to improve the ecological legal system of China from ecological security legislation is put forward.In the fifth chapter,the ecological system of Russia that focuses on preventing pollution from the source and exerting the role of market mechanism is summarized and analyzed.The basic connotation,procedures,principles,characteristics and functions of the system are summed up.The internal relations and rules between systems are revealed and the path of constructing Chinese ecological system is put forward on the basis of analyzing and comparing the ecological systems in China and Russia.In the sixth chapter,a general overview of the form,working framework and operation mechanism of Russian eco-international cooperation mechanism is given and the emphases of the ecological international cooperation in China are brought forth on this basis.The seventh chapter focuses on conclusions based on the study of the paper.In this paper,its reference for the ecological civilization construction in China is studied from the perspective of the construction of Russian ecological legal system,which is the theoretical and practical subject of inter-disciplines involved in the Sinicization of Marxism.The paper vigorously adopts systematic analysis,empirical research and literature research.With Marxist stance and opinion,it fully applies law,ecological science,ecological philosophy,ecological economy and other basic disciplines.The theoretical and practical problems covered by Russian ecological legislation system are analyzed.Then the special practices and experience like its ecological culture system,ecological management system,ecological legal system,ecological system and ecological international cooperation mechanism are summarized.Consequently,on the basis of previous studies,some new research perspectives and solutions for the construction of China's ecological civilization and ecological legal system are provided. |
