Research On The Legal Protection Of Education Rights For Left-behind Children In Rural My Country

Since the reform and opening up,many population migration has made great changes between urban and rural society.Young and middle-aged people who were originally working in rural areas have poured into cities to work in large numbers.Rural left-behind children are in the critical period of receiving education.The education of rural left-behind children needs our attention.If we can not solve the problem of education of rural left-behind children,it will pose a great threat to the good and steady development of society.Therefore,it is urgent to protect the right to education of rural left-behind children.The state pays more and more attention to the right of citizens to education.Article 46 of our Constitution establishes the right and duty of citizens to education.The state guarantees citizens' right to education from the constitutional level,which fully shows that the state attaches great importance to citizens' right to education.Both the Education Act and the Compulsory Education Act provide further provisions on citizens' right to education,which provides a legal basis for the protection of the right to education of rural left-behind children.Although there are many laws on children's education in our country,in practice,due to the transfer of a large number of rural young and middle-aged labor force to country,Urban and rural economic development imbalance,and the weak legal operation in the field of rural education,there are still some problems in the protection of the right to education of rural left-behind children in our country.In order to solve the problems existing in practice,it is necessary to make a futher study on the protection of left-behind children's right to education in rural areas.This paper first defines the concept of rural left-behind children and analyzes the general theory of the right to education.This paper discusses the value of legal guarantee of rural left-behind children's right to education in China.By analyzing the existing circumstances of the legal guarantee of the right to education of rural left-behind children,it is obvious that the right to education of rural left-behind children has a series of practical problems,such as imperfect legislation,lack of special law,weak legal maneuverability,lax administrative law enforcement,weak supervision of administrative law enforcement,imperfect complaint system and imperfect litigation system.Therefore,our country should take practical measures on the basis of learning from the advanced experience outside the region.At the legislative level: follow the Constitution as the fundamental,improve the relevant legislation,enhance the operability of laws in the field of education,and formulate special laws for rural left-behind children.At the level of law enforcement: improve the basis of government law enforcement,improve the supervision system of educational law enforcement.At the level of legal relief: improve educational administrative relief,improve educational judicial relief.The author expect to solve the problems encountered in the legal guarantee of the right to education of left-behind children in rural areas in China,and finally achieve the purpose of safeguarding the basic rights of citizens.
