Uniformity or incongruity: Cyberbullying laws juxtaposed with bullying laws and their effectiveness in punishing crime

Abstract/Summary:
From my readings, there seem to be discrepancies between the judgments produced on cases related to cyberbullying when compared to bullying that was not related to cyber. This discrepancy seems to exist even in cases where the offense appears to be very much the same. This research sampled cyberbullying cases and bullying that was not related to cyber. Adopting a similarity criterion based on the age group of victims and the accused, the offenses and the dates of occurrence, court cases were selectively examined. The judgments produced in the events were compared between cyberbullying and bullying not related to cyber. A comparison criteria focused on the judgment process, the verdict, the evidence collected and presented was used. The research attempted to identify differences or similarities that explain the uniformity or incongruity of the verdicts using Heuer's ACH Matrix process. The research concluded with reasons that clearly points to the uniformity or incongruity of cyberbullying laws and bullying laws where they existed and the effect in punishing cyberbullying. The overall object of this study is to illuminate the importance of adapting scientific methodology in the study of cyberbullying and as a backdrop to further empirical research about the phenomenon.;Keywords: Cybersecurity, social studies, deviance, immaturity, suicide, criminology.
