A Century Of Rural Construction History And Rural Construction Rights Research

As a great agricultural country,rural population,land and construction development has always been China's primary issues.Village prospers,country declines.Our rural areas have been in a traditional and backward state for a long time,it is the principal contradiction in China's unbalanced and inadequate development.Under the background of rural revitalization and urban-rural integrated development strategy,it is needed to solve a series of problems in the current academic and practical fields,such as how to give full play to the joint efforts of villagers-collectivity-government-market,and compile the planning and construction of rural areas in a scientific and orderly way.From the perspective of rural construction right,this paper analyzes the "power" distribution and "right" entitlement of rural construction,and constructs the rural construction's historical stages.Combined with the construction changes of 3 Yinzi villages based on the rural construction right,This paper discusses the distribution and enjoyment of rural construction right in rural planning and construction,and attempts to mediate and transfer the rights among multiple implementers.The main research contents of this paper include the following aspects:Firstly,this paper defines the connotation of rural construction right and the multi-subjects,through combing and analyzing the relevant research results at home and abroad.From the perspective of "power" distribution and "right" entitlement,the author proposes three types of rural construction and five types of rural subjects.Three types of rural construction includes villagers' houses,infrastructure and enterprise facilities.It also consists five types of construction subjects: individual villagers,village collective organizations,township governments,social organizations and market subjects.This paper further discusses the ownership,use,management and other rights of construction subjects in different historical periods,and the different roles they play.Secondly,based on the perspective of rural construction right,the author stages the rural construction process since the founding of the People's Republic of China,and make the rural construction before the founding as the background.According to law and government policy decisions,this paper divides the process of rural construction in China into four stages: the period of "joint and private construction"," public and common construction","public and self-construction",and " Co-construction and sharing ".From the focus and practical effect of rural construction,this paper summed up nine characteristics of the historical stage.Thirdly,taking the 3 villages' construction in Weihai Yinzi as an empirical study,the author studied the evolution characteristics of rural construction right in different periods.And then,from three constructions and five subjects,this paper studied the distribution and entitlement of rural construction right in each period,analyzed the problems of planning and construction,such as the lack of participation of villagers,weak of forward-looking and systematic thinking.Finally,in the planning practice of Yinzi 3 villages,this paper discussed the organizational mechanism of multiple subjects.At the same time,it carried out the adjustment,transfer and reconstruction of ownership,right to use and management.This paper also put forward the rural construction ideas and the guarantee measures that according with the market principle and the balance of interests.
