Research On The Establishment Of Public Lending Right System In China

In early nineteenth Century,the public library with the rapid development of economy and technology in Europe and is complete;at the same time as the people's growing awareness of the law,the conflict of interest between the public and the public library book borrowing behavior right.With the intensification of contradictions and the progress of social civilization,some scholars have put forward the system of public lending right,so far,at least 50 countries in the world recognized the public lending right system.With the gradual strengthening of international intellectual property rights and the rapid development of the cause of the library,the public lending right system gradually surfaced,causing the attention of scholars in china.The so-called public lending right is the right of the copyright owner or the neighboring person to obtain a certain compensation for their copyright works or copyright products are free of charge by the public library.This paper will summarize the origin and development of public lending right,and focus on the existing public lending right system,and then compare the course of China's development,from China's specific national conditions,comparative analysis,and further analysis of Public Lending Right in our country,the significance of the establishment,and thinking about the present stage of our country according to the national conditions and how to establish the system of public lending right,and coordinate the relationship between the various interest groups,both to ensure the balance of interests of readers and copyright,and ensure the sustainable development of digital publishing and digital library,the establishment of a suitable for our country public lending right system.This article is divided into 5 chapters.The first chapter is the introduction.The background and significance of the selected topics,the research status quo at home and abroad,the research contents,the research methods and the main points of the research are summarized.And an overview of the system of Public Lending rights.The concept of public lending right,right and ownership,legislative purpose,and its production and development are concretely expounded.The second chapter studies the significance of the establishment of the system of Public Lending Right in our country,respectively,from the necessity and rationality.The necessity is mainly from the construction of the legal system,the copyright owner's copyright and the development and protection of the national culture.Rationality is a summary of some scholars' difficulties in establishing public lending right in China.At the present stage of our country,the development stage of China now has the conditions to solve these problems.The analysis of the business level of the economy,law,technology and the work of the library.The third chapter mainly analyzes the British and German public lending right system case analysis and comparison,respectively from the legislative mode,management mechanism,compensation and calculation and distribution were analyzed and compared,from the enlightenment to our country.The fourth chapter puts forward the countermeasures to establish the system of Public Lending Right in our country.First,some problems still exist in our country,and then the concrete countermeasures to establish the right of public borrowing and reading are put forward.It includes improving the concepts of citizens and libraries,establishing and improving the management institutions of Public Lending rights,perfecting relevant laws,ensuring the calculation and distribution of government financial appropriation and compensation,and conducting pilot projects in some academic monograph.The fifth chapter is the conclusion and the prospect.First,we put forward the research conclusion,and then put forward the prospect.We will analyze the research of the digital library and digital publishing in the public lending right system under the background of resource sharing.Hope that all the scholars are involved in basic research and the related theory make efforts to gradually establish its practical basis,to further improve the system of practical experience in the process,both to ensure the balance of interests of readers and copyright,and ensure the sustainable development of digital publishing and digital library,and finally to pave the way for our library the legalization and standardization development.
