Research On The Legality Of The Anonymous Communication Of The Internet Information

The transmission of anonymous information has been a controversial topic since ancient times.For the Internet,anonymous information is widespread,and anonymity is one of its biggest features.On the Internet,the legality of anonymous communication becomes a topic worth discussing.One of the focal points of this discussion is the two-sided effect of Internet information anonymity.The existence of anonymous communication on the Internet has its own unique reasons and its positive and negative effects.In this paper,the author uses the theory of communication theory to analyze the theoretical mechanism of the existence of anonymous reality,which include the self-interest theory mechanism and the psychology of use and satisfaction of citizens existing in Internet anonymous communication;the agenda setting function in the Internet communication that is conducive to the social democratic process;the influence of the effect of the unreal anonymous news,and the limited effect that it forms.The positive and negative effects of Internet information anonymity also leads to the discussion about its legality.During the time of thinking about this problem,this paper makes an analysis from the perspective of jurisprudence,focusing on the risk and risk aversion.This paper puts forward some concrete measures to reduce the risk of Internet information anonymity.Specifically,apart from introduction,this paper is divided into four parts:The first part is the analysis of the status and the advantages and disadvantages of Internet information anonymity,namely the analysis of phenomenon and cause of the research problem of the paper.The present situation has its main manifestation and cause.The main reason of the formation is the two main reasons,obtained by combining the theory of Communication science.However,the illustration of advantages and disadvantages analysis is as follows:meanwhile the anonymous Internet information transmission broadens the ideas and information dissemination channels,promoting the popularization of media contact and the use of common and beneficial effects,it also brings some drawbacks and negative influence.For example,it is probable to harm the public's right to know.And it may also be inclined to insult and slander others and leak the state and commercial secrets and so on in consequence of its anonymity.The second part mainly introduces the positive and negative effects of the Internet's anonymous communication,which leads to the controversy about the anonymous communication of information,and the influence of the Internet information transmission.Throughout the American judiciary,there was a debate about whether anonymous communication was legal.These debates are more unique and meaningful in the Internet age.In the Internet age,the dispute is mainly concentrated in the debate about the influence of anonymous regulation of Internet information transmission on freedom of speech and information transmission on the Internet with partial limited real-name countermeasure thinking and advice.Among them,the legal thinking about whether the Internet information transmission should be legal is more mapped.The third part is one of the main parts of the article,which mainly discusses the legal factors involved in the main points of the article.Here,the legal theory of exploring the legitimacy of the anonymous Internet information communication is the perpetrator should be responsible for his words and deeds,and the legal protection can be lowered down properly under unequivocal risk warning.There is some logical correlation between the two legal factors.The last part is based on the analysis of the above communication and legal theory basis,puts forward my own point of view,analyzing the legitimacy of the anonymous internet information communication,and then proposes the risk aversion countermeasures and thinking against the current situation.About the risk reduction measures are suggested as follows:perfecting the risk intimation and credent rating system,attaching importance to on the network media literacy and the formation of the social cohesion and so on.The research on the topic is aimed at providing reference for solution of the problem in practice.
