Study On Legal Liability Disputes Of College Students Suicide

In recent years,the suicide of college students is on the rise.Based on this situation,it is particularly important to reasonably identify the responsibilities of all parties in the "college student suicide" event.On the one hand,this is the premise and basis for colleges and universities to bear the responsibility.On the other hand,whether colleges and universities should bear the legal responsibility for this event,and then how to bear the responsibility will naturally become a hot issue of research.Based on the suicides of college students,this paper introduces the basic research theories such as the legal relationship between college and students,the composition of the legal responsibility of College Students' suicides and the identification of school faults.On this basis,by searching the real cases on China judicial document network and Internet platform in recent years,this paper analyzes the causes of College Students' suicide and the division of College responsibility in student suicide events,further analyzes the practical difficulties faced by college students' suicide legal responsibility,and then puts forward relevant strategies to solve the problem of College Students' suicide school legal responsibility.The paper is divided into five parts.The first part introduces the problem of College Students' suicide,gives the purpose and significance of this study,on the basis of defining the core concepts,analyzes the research status at home and abroad,puts forward different research methods,and points out the innovation and shortcomings of this paper.The second part expounds the theoretical basis of the legal liability of college students in suicide.That is,to correctly define the legal relationship between colleges and students,to analyze the composition of the legal responsibility of colleges and universities,to identify whether there is fault in Colleges and universities,and finally to analyze the legal basis of the legal responsibility of colleges and universities.The third part,combined with the typical cases in judicial practice,analyzes the causes of suicide of college students and the division of responsibilities of colleges and universities in judicial practice,mainly including: colleges and universities bearthe main legal responsibilities,colleges and universities bear part of the responsibilities,as well as the compensation responsibilities and economic subsidies of colleges and universities,so as to provide practical basis for further analysis.In the fourth part,the author analyzes in detail the practical difficulties faced by college students' legal responsibility for suicide,mainly from three aspects: the lack of laws and regulations in China,the lack of clear subject of responsibility and the lack of ways to realize legal responsibility.In the fifth part,aiming at the existing problems,the author puts forward the relevant strategies to solve the problem of College Students' legal responsibility for suicide,namely: making laws and regulations,improving the loopholes of laws and regulations;combing the relevant legal relations,clarifying the school's responsibility;establishing a social sharing mechanism to alleviate conflicts;building a defense line of psychological crisis to avoid accidents.
