In recent years,the behavior of organizing Chinese citizens to go abroad for gambling is very rampant.This kind of criminal behavior not only brings bad social influence,but also causes a large amount of capital outflows in China,endangering national financial security,affecting economic order,and bringing economic development to China.It is a serious hazard.However,due to the strong concealment and convenience of such crimes,and the difficulty of investigating and collecting evidence by overseas public security organs in China,it has brought certain difficulties to punish such criminal acts.A large number of cases show that organizing Chinese citizens to go abroad to gamble will not only affect the social security environment in the border areas where casinos are opened,but also some lawless elements use overseas gambling to set up traps to organize personnel to conduct extortion and fraud in the name of overseas gambling.Behavior has caused many adverse effects on the domestic security environment.Under the rigorous situation of vigorously cracking down on various forms of gambling crimes in China,organizing Chinese citizens to go abroad for gambling crimes is still repeated,and the reasons behind it are worthy of further investigation.Judicial practice research found that in the name of tourism,the gambling behavior of the organization of personnel leaving the country,domestic and foreign illegal forces colluded to provide protection for overseas gambling,criminals to evade domestic heavier penalties by accepting foreigner's lighter penalties,etc.The investigation and evidence collection by the authorities has caused great obstacles,resulting in the inability of the case to be detected and the criminal procedure to be investigated.However,in the face of clear and well-founded cases,they have fallen into a serious case when trying to impose severe sanctions on the perpetrators in accordance with relevant laws.Another dilemma.China's "Criminal Law" and its related judicial interpretations are not perfect for the regulation of organizing Chinese citizens to go abroad for gambling crimes.Only in the "two high interpretations" mentioned the organization of citizens of the People's Republic of China to go abroad for gambling,from which certain forms of benefits are collected.It is a gathering of gambling stipulated in Article 303 of the Criminal Law.Obviously,such regulations have not been compatible with the increasingly complicated crime situation.In view of the fact that the Criminal Law has a slight criminal punishment for organizing Chinese citizens to go abroad for gambling,there is no clear regulation on the use of overseas gambling to conduct money laundering,and the issue of China ' s Criminal Law on the effectiveness of organizing Chinese citizens to go abroad for gambling,this paper proposes reconstruction.Organize the criminal elements of Chinese citizens going abroad for gambling,the statutory penalty for raising gambling crimes,the criminal punishment for organizing Chinese citizens to go abroad to gambling,and the participants who help this behavior,and strengthen international judicial cooperation,and for money laundering and The issue of space effectiveness and other issues put forward the perfection of thinking,in order to improve the criminal law of organizing Chinese citizens to go abroad for gambling crimes.
