Research On The Protection Of Women's Labor Rights And Interests Under The Background Of The Second Child Policy

Fully implement the two-child policy,that is,All couples are allowed to have a second child regardless of region or nationality.The aim is to alleviate the pressure of population aging,optimize the structure of labor force and promote social sustainable development.Data show that since the implementation of the comprehensive two-child policy,although there are some positive responses in the two-child birth population,the total number of newborns is still showing a downturn trend,unable to achieve the expected goals of the new policy.The main reason is that China's current system of women's labor rights and interests protection has been difficult to adapt to the new environment of the two-child policy.Although some regions have begun to introduce the latest fertility policy to balance the reality of the contradiction between having two children and women's labor rights and interests,but related to the particularity of women's labor rights and interests protection,the current policy system still has some defects,women have many worries about having two children.Based on the concept of "labor rights and interests" and the particularity of "women's labor rights and interests",this paper defines the content and characteristics of "women's labor rights and interests".Based on the current social environment,this paper analyses the impact of the two-child policy on society,employers and individuals.List the manifestations of women's rights and interests infringed under the background of the two-child policy: employment discrimination intensifies;labor rights and interests are not guaranteed;physiological and psychological burden increases.Analyse the particularity of the infringement and the reasons behind it.Using gender theory,special labor protection theory and state obligation theory,combined with questionnaires and official data,this paper analyzes the shortcomings of women's labor rights and interests protection system: the system of women's equal rights to work is not perfect;the special protection system is not perfect;the reproductive security system is not perfect;and the supervision mechanism is not perfect.Through the comparison of old and new policies,and the new concept of security system,the final analysis and put forward the corresponding countermeasures.Through improving the legislation,judicial relief system and social security institutions to improve the protection system of women's equal rights to work,create a special protection system,optimize the birth security system.At the same time,we should improve the supervision system to effectively supervise the implementation of the women's labor rights and interests protection system under the background of the new policy.Through the improvement and control of various links,the system of women's labor rights and interests protection can match the two-child policy,and form a reasonable and effective protection of women's labor rights and interests,thus promoting the implementation of the comprehensive two-child policy and helping the economic and social development of our country.
