Case Study On The Effectiveness Of Dispute Mediation In Rural People's Mediators

Since the process of urbanization in the country,the rural areas of traditional acquaintance society have gradually moved closer to the direction of strange cities.This has led to an increase and intensification of contradictions in rural disputes.In this process,rural people's mediators played an increasingly important role in the socialization of disputes in rural areas and the maintenance of public order.From the perspective of “Great Public Security”,This article uses field research methods to go deep into the rural grassroots to study the mediation mechanism of the people's mediators.Then,this article judges the effectiveness indicators of the people's mediators' mediation disputes,and finds out the problems that affect the effectiveness of the rural people's mediators in resolving disputes.Finally,combined with the influence factors of effectiveness,it proposes some research countermeasures to improve the ability of rural people's mediators to resolve conflict conflicts.This study takes the effectiveness of rural people mediator dispute resolution as the research object.The study found that the effectiveness of the mediation of rural people mediators was relatively low.On the one hand,the number of cases where the follow-up relationship was restored was relatively small,and the number of cases where there were cracks in the relationship was large.On the other hand,the villagers' satisfaction with the results of mediation by the people's mediators was not high.From the relevant data of the effectiveness research indicators,we also found several problems:first of all,some civil disputes can easily lead to new sub-disciplines and intensify conflicts;secondly,both parties to the dispute have a low degree of satisfaction with mediation by the people's mediators;Then there is a rift in the follow-up relationship between the parties to the dispute.Finally,there are problems such as deviations in the role of rural people mediators.From the current situation analysis of factors affecting the validity of the results is as follows:Expected benefits are the most important factor affecting the success and failure of mediation;Interpersonal relationships always influence the mediation process,promote and change mediation outcomes;The public confidence of the people's mediator is an important guarantee for the success of the mediation result;The spirit of law and traditional moral habits are important basis for influencing the outcome of mediation.In this study,the following suggestions are put forward to rationally allocate the expected interests and resolve the conflict contradictions;to do the "Legal Guide",carry out the concept of compliance with the law and abide by the law;to resolve the disputes flexibly according to the traditional morals and customs;clarify the interpersonal relationship and use the hologram mediation mechanism to resolve the contradictions and disputes and improve the satisfaction of the villagers;To improve the credibility of the rural people's mediators,three "intentions" to eliminate "heart thorn";regulate the professional development of the rural people's mediators.From the perspective of resolving contradictions in rural disputes,rural people's mediators,as security entities in rural communities,have played a part of the role of the main body of public security.The rural people's mediator is an important force to resolve the contradictions in rural disputes.
