Cultural relic buildings are precious cultural resources that are non-renewable.They are the historical roots for inheriting and promoting the fine traditional culture of China.In recent years,remarkable achievements have been made in the protection of cultural relic buildings in China,and the awareness of cultural relics construction in the whole society has been further enhanced,and the breadth and depth of the use have been continuously expanded.At the same time,however,the protection and use of heritage buildings in China also face some new problems and difficulties.Among them,the Cultural Relics Protection Law of the People's Republic of China prohibits any form of transformation of cultural relic buildings.The strict control of laws and regulations and the practical use of many cultural relics and the re-use of cultural relics have great and difficult to reconcile conflicts.Protection and the implementation of the Cultural Relics Protection Law of the People's Republic of China have caused great confusion.Different from the regulations related to the protection of heritage buildings in China's interior,the rules of relevant laws in foreign countries and in Hong Kong,Macao,and Taiwan are more flexible,and there have different requirements in terms of the transformation of heritage buildings of different types and levels of protection.In response to this issue,the relevant academic research is also very scarce.Based on laws,regulations,and actual cases,it is of great academic significance and use value to explore the conditions and regulations governing the transformation of cultural relic buildings in the relevant laws and regulations of overseas typical countries and regions,and to explore the regulations and actual operational improvements in China.In order to solve this enormous and difficult to reconcile contradiction between the actual use of laws and regulations and cultural relic buildings construction,this article explores comparatively the protection systems,regulations,and transformation conditions related to cultural relics and reconstruction of typical overseas countries and regions.The different types of protection grades for different cultural relics and the three types of restrictions for the transformation typical countries and districts abroad are sorted out: prohibition of transformation,restriction of transformation,strict examination and approval and specific guidelines.The overseas cultural relics and architectural reconstruction cases were summarized and summed up to explore the overseas cultural relics construction transformation and utilization models,transformation methods,transformation principles and characteristics.Finally,we propose improvement strategies and suggestions from two different perspectives: current and long-term.This article first elaborated on the contradiction between the current cultural relics law and cultural heritage construction in China,pointed out the importance and necessity of the research topic,and then introduced the legal policies of Hong Kong,Macao,and Taiwan and overseas typical countries that differed from the protection system for cultural relics and buildings in mainland China.The various rules and conditions for the transformation and utilization of cultural relics buildings were used,and comparatively comprehensive comparative studies were carried out.At the same time,the four aspects of overseas cultural relics construction transformation,utilization methods,principles,and characteristics were combed in conjunction with the case of overseas typical cultural relics buildings.Summing up,the final analysis concludes that the current laws and regulations in our country need to be improved,and proposes specific amendments to the Cultural Relics Protection Law of the People's Republic of China and Regulation for the Implementation of the Cultural Relics Protection Law of the People's Republic of China under the current national conditions,and addresses China's heritage protection system and practice.On the other hand,it puts forward the thinking of further improvement and development for the relevant academic circles to discuss.
