After seven times of public opinion climax,public opinion,mass media reports,retrial of the second instance overturned the verdict...Taking the Li Changkui case as the representative,the influence of the public opinion and the media on the judicial trial can be seen.The impact is complex,not simply "kidnapping" justice by public opinion or supervising justice by the media.With the advancement of the process of rule of law,judicial activities are no longer a monologue of the judiciary.Not only from the point of view of the necessity of full expression of public opinion,but also from the needs of the judicial organs.The influence of external factors,especially public opinion,on the trial is inevitable.From a practical point of view,on the premise of affirming the positive influence of external factors,we should make more narrations on the negative effects of external factors.It seems inevitable that external factors,especially public opinion,because of lack of professional vision,impulsive emotional fluctuation,conformity and blind psychology,conflict with serious and rational judicial trial.From another point of view,it is necessary to learn the causes of conflict between public opinion and judicial trial,construct the positive interaction between external factors and judicial trial by perfecting judicial independence,setting up scientific public participation mechanism,strengthening the publicity of judicial information,and rationally restricting the supervision power of the media.Of course,the path to good interaction is not the mileage of a sprint race,it may be a national marathon.
