Analysis On Present Situation Of Chinese University Statutes Construction And Research On Corresponding Countermeasures

With the promotion of managing colleges and universities according to law and the construction of the modern university system, our country began to fully develop the university statutes. The construction of the university statutes is to follow and implement the rules of law in university governance, is helpful to perfect the system of modern university in our country, is to regulate the development of university and exercise autonomy, is to maintain and carry forward the concept of university academic freedom. In 2010, the ministry of education made it clear that all colleges and universities in our country should strengthen the construction of the university statutes, and manage colleges and universities according to the provisions of the statutes. As of June 2015, the national "211 Project" university took the lead in the completion of the release of statutes, and breakthrough progress has been made in the construction of higher school regulations. However, some colleges and universities do not pay enough attention to the construction of the statutes, which is not in accordance with the regulations of school management, which seriously violated the original intention of the construction of the university statutes. Therefore, the university statutes construction questions need to be further discussed.Therefore, this research adopted literature analysis, text analysis and comparative analysis methods, combed the development course of the university statutes, analyzed the connotation, features and value of the university statutes. On this basis, with the latest issued constitution text combined with the reality as the research object, this study systematically analyzed the construction situation of the university statutes from three aspects:content, formulation and implementation, summarized the positive progress which was made in the construction of the university statutes, summarized the main issues which was existing in the construction of the university statutes and found out the reasons. Finally, in order to promote the rational construction of Chinese university statutes, successful experience was used for reference by comparing the European and American university statutes.Based on the above research, this paper found that positive progress has been made in the construction of the university statutes. All colleges and universities in strict accordance with the requirements of the statutes, actively improve the internal governance structure, and strengthen the autonomy of running the school. However, there are still some problems existing in Chinese university statutes, such as the content convergence of statutes, the imperfect modification program, the unclear legal status, the lack of supervision and evaluation mechanism, and so on. In addition, this study found that the European and American university statutes had unique characteristic, academic freedom, strong execution and good implementation effect. Therefore, this paper put forward some countermeasures to solve the current problems of the university statutes and ensure the effectiveness of the university statutes:improve the contents of statutes and highlight its own characteristics; fully reflect the wide range of multiple participation and standardize the development and modification of procedures; clarify the legal status of the statutes and improve the relevant laws and regulations; government advocates strengthening the importance of the university statutes; introduce the responsibility chased into system, improve the evaluation mechanism and construct university statutes with Chinese characteristics...
