Study On The Legal Protection Mechanism Of The Stable Right To Work

The stable right to work is a very important right for protecting the rights and interests of laborers. It is a kind of right that labors should keep their work stable in the process of their career. The stable right to work is not mean laborers must be in certain jobs forever, and our society also cannot make sure every laborer’s job is absolute stability.Since our country’s economic system transformation from the planning economic system to marketing economic system,the model of employment has changed.In the background of planning economic system,the laborer’s job was arranged by country.However,when come to the society of marketing economic system,the labor market is opening and the laborers can look for jobs according their own will.Under this model of employment,the labor resources can go to the most suitable place and achieve it’s value.But at the same time, The stable right to work of laborers in our country is suffering the huge impact and the phenomenon of work lacking stability is serious.This unstable phenomenon about working brings many negative influence to laborers.It is disadvantage to the development of companies and country,and even more the social harmony and stability. So we must take measures to protect the laborer’s stable right to work.This paper can be divided into some parts as follow:The first part is an overview of the stable right to work.As a fundamental part of this paper,it introduces the concept of the stable right to work,discusses the meaning of "stability" and its characteristic,expounds significance for the legal protecting of stable right to work.In the second part,we talk about the current situation about legal protection of the stable right to work.Through to analyze labor law’s shortages on protecting the stable right to work,we figure out the questions and its reasons in protecting the stable right to work.The last part focuses on the advice to perfect the legal protection of the stable right to work,and puts forward legal suggestions from the view of labor contract system、fire protection system and the trade union system.
