With the development of the society, the law has advanced and citizens’awareness of right and equality are also awakened. The voice of claiming for the legal protection of the equality rights of employment is stronger and stronger. In recent years, the trend of the protection is obvious among all walks of life. However, due to the long-term neglect of the protection of the private rights, nowadays, many kinds of employment discrimination is still very serious. After introduced many kinds of the discrimination phenomena in China, we can draw a conclusion that the protection of the equal right of employment is unfavorable, whether the legislation or the justice, furthermore, the article focuses on the basic issues of the conception and the definition on the employment discrimination. Simultaneously, the author state the relationship between the equal right of employment and the human right systematically-the former is the basic constituent part of the latter, so we can see the importance of the equal right. In addition, compared with Germany, the US and Holland, this thsis does a research on the legal institution about anti-discrimination employment, observe the model of legislation and administration of justice, finally find out the experience that we should learn. The author advocates to establish an organization, called the Equal Employment Opportunity Commission, which belongs to the central government and solve the dispute on the discrimination of the employment. It is not only for meeting the international standard, but also for showing the determination to protect the equal right. The author makes a summary at the last of the paper and gives some advice to improve the legal system.
