With the rapid development of economic, accelerating of the urbanization process andunceasingly expands of the city scale, thus brought a series of problems such as the tension ofurban land, traffic congestion, insufficient of urban green space and severe pollution and so on.It becomes mutual interest of how to solve these problems to the most countries around theworld. In1982, the meeting of Committee on Natural Resources (CNR) pointed out: theunderground space is the potential and ample natural resources to human. Since then, theunderground space was gradually regarded as an important way to break through thebottleneck of urban to each country.At present, we are taking measures to develop and utilize the urban underground spaceon a large scale to alleviate these problems in many cities as urban Beijing, Shanghai,Hangzhou, etc. Legislation, however, so far, there has not set up a complete legal system ofurban underground space in our country. It restricted the city underground space developmentand utilization because of haven’t a clear definition on underground space property rightincome distribution. This article will make carding of domestic and foreign urbanunderground space property rights definition, and based on the theory of property, land rentand price, and income distribution, to discuss the underground space of land property rightand income distribution problem comprehensive and systematic.The article is divided into six parts: the first part is the introduction, it will analysis thebackground, purpose, contents and methods, as well as the issue of research and content suchas the legislative status quo on both domestic and foreign scholars. The second part is basictheory, it mainly to define the main concept and generalize the theoretical basis in this article.The third part will take the legislation and academic discussion of urban underground spaceproperty rights as the foundation, define the subject, object, content, etc of the urbanunderground space property rights, and analysis the acquirability, registration, deadlines ofland use rights for urban underground space, at the same time, it will define the propertyrights of special circumstances such as pipeline engineering, leased land and public space inthe process of using underground space. The fourth part will discuss the land price evaluation and the optimum depth of the cityunderground space, and put forward a suitable method for land price evaluation of urbanunderground space. After the fifth part will make a research of income distribution problemsfor land development and utilization of underground space, analysis the interest relationsbetween the land owner, user and the real user, and the incomes of each subjects by the landdevelopment and utilization of underground space and its forms. The sixth part is theconclusion, summarizing the main contents and achievements of this paper, and put forwardthe idea that the next step research for the deficiency of this paper.
