The implementation of the system of anti-monopoly is a more important guarantee to suppress monopolistic behavior, protect the legitimate rights and the interests of consumers more effectively, and to maintain the healthy competition order of market. In this respect Japan has a successful experience. In addition, the anti-monopoly law of Japan which is mainly based on the administrative enforcement and it usually regarded the private implementation as a supplement. So it is not only similar to our implementation of the system of anti-monopoly law and the legislative experience of Japan also has a significant meaning in the anti-monopoly for us. Therefore, we want to find the issues which are in the implementation of our anti-monopoly law by contrasting with the Japanese anti-monopoly law.This article divides four chapters besides foreword:The first chapter has introduced the legislation background and revise of Japan and China’s anti-monopoly law, which is mainly to lay the foundation for comparison between the implementation system of Japan and China’s anti-monopoly law.The second chapter has analyzed the administrative enforcement of Japan’s anti-monopoly law. And by the comparing our system the establishment of anti-monopoly law enforcement authority and the surcharge system of Japan are important reference to us.The third chapter mainly studied on the private implementation system and the enforcement of anti-monopoly criminal policy in Japan and China. And to find the issues which hinder the process of the implementation of anti-monopoly law.The forth chapter is aimed at the issues of the implementation system of China’s anti-monopoly law, we try to make suggestions of revising the legislation which are in the implementation system of China’s anti-monopoly law by learning from the experience of Japan.
