Crimes against humanity is a kind of crime in international criminal law,What’s referred as "the most evil of sin". It is one of the international crimeswhich the whole world has paid great attention. The Crimes against humanity canbe found in the "Treaty of Sèvres" of the twentieth Century in the beginning. The"Charter of the International Military Tribunal" clearly stipulates the Crimesagainst humanity, and put it into practice. Crimes against humanity developswith the continuous development of international criminal law. And theinternational community has paid more and more attention to it.The paper is conducted by kinds of research methods including literatureanalysis, normative analysis, case analysis as well as comparison analysis.Through reviewing the development history of Crimes against humanity, thepaper divides the history of crimes against humanity into two phases with theclue of legislation period. The paper has conducted a research on two phasesespecially on the changes in different phases, focusing on the innovative parts ofcrimes against humanity in the present stage of development. The paper hasdiscussed from entity creation and procedures creation and has concluded thatthe" Rome Statute of the International Criminal Court" is a monument in thehistory of crimes against humanity. The Libya situation is the latest judicialpractice of crimes against humanity and enriches the content of crimes againsthumanity. Through the in-depth analysis of the Libya situation, the paper hassummarized four aspects of the judicial creation of the Crimes against humanity.There is no doubt that crimes against humanity has new development now. Thus,in theory, the characteristics of practical rules of Crimes against humanity and itstrend can be defined clearly. So from this perspective, the paper has made up thecurrent research on the crimes against humanity. In practice, the Libya trialpractice has made an example for other countries, and it’s also has profoundrevelations on attitude of justice, rule of law, diplomacy and so on.
