On Liability Investigation System For The Disclosure Of Chinese Governmentinformation

Ever since the issue of ’Regulation of the People’s Republic of China on the Disclosure of Government Information’(shortened as ’Regulation of Information Disclosure’) on1May,2008, the Regulation has played a very positive role in making government affairs public and promoting the building of democracy and rule of law, but there are still many problems, such as the common phenomena of government shifting responsibilities and arguing back and forth. In order to strengthen the implementation of ’Regulation of Information Disclosure’ and accelerate solving those problems existing in applying the ’Regulation’, a complete liability investigation system for the disclosure of information needs to be established to restrain government’s inappropriate behaviors and protect the construction of a society ruled by law.Based on absorbing the essence of other research results, this dissertation chooses to analyze liability investigation system for the disclosure of Chinese government information from the perspective of administrative accountability.It starts from discussing those problems in implementing ’Regulation of Information Disclosure’ and therefore puts forward liability investigation system. Following an introduction to relevant theories, the formulating, implementing of liability investigation system for the disclosure of information and those implementing problems are discussed in all provincial administrative institutions’level. Combining Chinese social characteristics with overseas administrative accountability systems, some suggestions are made on perfecting liability investigation system for the disclosure of Chinese government information.The dissertation is divided into four chapters:Chapter one introduces relevant theories of government disclosure of information and liability investigation system and their relationships; Chapter two analyses the weakness and the reasons of improving liability investigation system in terms of the current situations of liability investigation system of Chinese government disclosure of information; Chapter three describes the administrative accountability systems in the US, Britain, France, Japan and meditates on the inspiration of those systems to Chinese liability investigation system; Chapter four gives advice on perfecting Chinese liability investigation system, which include defining the principles, subjects, and contents of administrative accountability system.
