The Construction Of Legal System Of Urban And Rural Planning And Implementation Of Research

The new "Urban and Rural Planning Act" clearly stipulates the principle of "building after the planning", and determines the leading position of the urban and rural planning guidance. Urban and rural planning is not only a powerful means of state regulation of economic and social development, but also a public policy directly or indirectly related to the vital interests of the of the ordinary residents of thousands of households. Legal system of urban and rural planning is a core part of the urban and rural planning system, which runs through each process and procedure of urban and rural planning preparation, urban and rural planning approval and urban and rural planning management. The promulgation and implementation of the "Urban and Rural Planning Act" is the significant progress of the legal system of China’s urban and rural planning, which provides the opportunity and institutional safeguard for the reform and innovation of urban and rural planning. But as to the problems of the existing legal system of urban and rural planning, how to further improve and perfect will be a major issue.This thesis, through the investigation and study, analyzes the legal system of urban and rural planning itself theoretically; and discusses in depth the construction and implementation of our present legal system of urban and rural planning, as the City of Tianjin an example. In regard to the existing problems of the system, the construction and implementation, and the propaganda level of the legal system of urban and rural planning, and the supervision to the government function, learning from the advanced experience from abroad and domestic relevant regulations, this paper, mainly from perfecting the legal system, promoting the administrative system reform, improving the law enforcement ability, and strengthening the law theory research and education and training and other aspects, describes and recommends on how to perfect legal system of urban and rural planning, that through a series of measures on legislation, administrative reform, theoretical study, public education and so on, strengthens the scientific and authoritative of the legal system of urban and rural planning.
