The teacher's power and the student's right depend upon and also clash with each other. The teacher's power is the alienation of parts of student's right. From the perspectives of law, society and teachers themselves as well as student's characteristics, the existence of teacher's power has its rationality to a certain degree. However, some teachers take advantage of their privileges to punish students at will, which infringe student's right. Such action is not only against law, but also inconsistent with educational humanitarianism principles .As to teachers, one of their most important authorities is the right of discipline, which is the center and emphasis of this paper. But the teacher's right of discipline is by no means equal to teacher's power .To this issue of teacher's tort, this paper aims at finding the solution from both internal and external aspects, so as to protect student's right from being violated.
