With the rapid development of Reform and Opening for 30 years, it is established that higher education system of our country which has become the most large-scale in the world, training thousands of high-level professionals and highly skilled personnel and achieving a series of world advanced level of scientific research, which contribute to the development of our country and nation. However, in terms of the development and the management of university, there is still a big gap between universities in our country and advanced universities in the world. Besides, it neither fully meets the needs of social and economic development, nor meets people's requirements to receive a good higher education. In order to break through the bottlenecks in the management of university, it is crucial to establish and improve the Statues of University to achieve the University Autonomy, Managing School by Laws, Academic Freedom. As the law, the Statues of University regulates scientifically the interrelation and action manner among every power subject between university and government, university and society, and inside the university, which is important to establish modern university system and construct high-level university. Therefore, it is very necessary to research the problems being existed in the construction of the Statues of University.The present thesis adopted the Marxist philosophy and education research techniques such as historical analytic method, literature law and comparison analytic methods to research the Statues of University in perspective of the University Management. This thesis is made up of five chapters.Chapter One firstly illustrated the background and the meaning of the research. Secondly, reviews the historical development of the Statues of University. Finally, on the base of summary and viewing the previous research situation and the reality of construction of the Statues of university, proposed the thinking and the methods of this thesis.Chapter Two dealt with the definition and the interrelated concepts. Defined the terms:Statues of University and Management of University separately. Contrast the Statues of University with Higher Education Act, University Regulations and Rules, Modern University System, University Development Plan. According to our country laws, this chapter describes the content and legal status of the Statues of University and emphasized the significance of the Statues of University in management of university.Chapter Three analyzed the main problems raised in the construction and practice of the Statues of university in details. It points out the problems from the following dimensions:in the formulation, in the content and in the implementationChapter Four comparative analogized four perfected texts of the University Statues in order to summarize inspirations. In this part, the author selected the texts from the University of Oxford in England, Yale University in the USA, Bochum-Ruhr University in Germany, University of Hong Kong in Hong Kong in form of table to list the legal statue, inner government structure, rights and obligations of teachers and students, the relationship between university and society, the feature of university, aiming at finding out experience and inspiration of worth learning.Chapter Five proposes the suggestions and proposals to the main problems that the Statues of University in our country faced to at present. Considering the beneficial experience and inspiration of perfected University Statues, the author put forward five suggestions to improve and implement the Statues of University in our country. To be specific, to enhance the cognition to sure the scientificity and effectiveness; to make clear accountability of related relationships; to give prominence to university features; to establish the supporting mechanism and measures; to summarize and learning from the perfected text of University Statues to advance the level of theory and practice.
