On The Construction Of The Case Law System In China

Case law which is as law-origin comparing with the statute law reflects the formation and development of Anglo-american's core doctrine—the rule of standing by things decided.Recently twenties', our state the main academic and practical pays much attention to researches on the case-systems in common law system.The author refering to greats deal of literatures including theories of jurisprudence,law methodology,history of legal system,politics introduces case-system's operation,its value,basic of philosophy,validity,necessity,rationality and Chinese realism demand.The author analyses the feasibility of constructing case-system and put forward advices to resolve difficult questions and to construct this system.
