Study On The China's Chinese Medicine Enterprises' Patent Stratagem Based On The Core Patents Analyzing

Chinese medicine is not only the quintessence of our country, but also is one of traditional preponderance industries of China which shows our ethical characteristics best. China has the irreplaceable advantages in the factors such as natural resources, massive cultural bedrock and abundant historical information in the field of Chinese medicine. What can not be ignored is that Chinese medicine industry has made an outstanding contribution for China's economic development. Among all drugs contained in the "national essential drugs list", has been wrote on People's Republic of China new medical reform program which announced in April 6, 2009, more than 50 percent are proprietary Chinese medicine or Chinese medicine. Chinese medicine will not only be used by our general population diffusely, but also play a more important role in the world pharmaceutical market for its low-cost and high-quality traits.With economic globalization and china's accession to WTO, Chinese medicine enterprises in China will be more extensive integration into the international competition environment. At present many countries have established strict patent barriers and Chinese medicine enterprises in China are faced with severe challenges in the competition. As an important component of intellectual property rights, Patents plays a particular vital role in Chinese medicine industry in China's development and internationalization. Establish and perfect the patent strategy is the necessary methods for traditional Chinese medicine production enterprises to enhance their core competitiveness in market competition no matter at home or abroad. Chinese medicine manufacturers must make good use of patent to protect them for avoiding the risk and grasp the situation and the rules as soon as possible to master the art of the self-defense and the winning way.In this paper, the author depth studied the status quo of patent of Chinese medicine enterprises in China and got the core IPC patent classes in China based on the comprehensive investigation and analyze of Chinese medicine patent literatures in our country. Based on the results, the author evaluated the status quo of patent strategy of the Chinese medicine enterprises in which the core patents were concentrated by using many instrumentalities such as drug maker patent strategy evaluation system, CHI patent Scorecard and SWOT analytical method. Through drawing on the United States, Japan and other country experience in patent strategy, the author focus on exploring the defects and countermeasures of Chinese medicine enterprises' patent strategy in china from the national and the enterprises two angles. And further, the author offered many constructive suggestions for a wide range implementation of Chinese medicine enterprises' patent strategy in our country. This study provides a scientific basis as a strategic choice and decision-making for the majority of Chinese medicine enterprises. The study has great theoretical and practical significance to enhance the core competitiveness of Chinese medicine industry in China.
