Comparision Research Of Telecommunication Regulation System Between China And America

With the growing of the information economy, telecommunication industry as a basic and pioneer industry has always been a focus to people, and, the wave of informationization pushes telecommunication industry to the top. The reason that telecommunication industry can gather so many eyes of people, not only because its very important position in the national economy, but also because it has been regulated by government for a very long time. Regulation generally refers to government regulatory policy and the consequent effects on market endeavors of enterprises by means of either permission or approval in accordance with relevant laws. The reason why government regulate telecommunication industry, there are three main reasons: First, the technical and economic characteristics of telecommunication industry make it a natural monopoly; second, telecommunication industry as the foundation of the national economy also is a pubilec utility; third, telecommunication regulation is for the need of national defense, national security and safeguarding consumer interests. Among them, the natural monopoly status is the decisive reason of the failure in market mechanism. Therefore, whether it is in order to make up for market imperfections or to balance the interests of the state, enterprises, and consumers, government regulation is the inevitably choice to improve the efficiency of telecommunication resource distribution, to ensure healthy development, and to increase social welfare.Modern telecommunication industry originated in the United States, since its birth, the regulation has been with it. With the pace of telecommunications' growth, it developed a comprehensive telecommunication regulation systems which followed by other countries. Since there is such a good existing swatch, then, how to reference the United States' telecommunication regulatory system for the advanced experience has been a problem of Chinese telecommunication regulatory system that receives prevalent attention. By mean of theoretical analysis, proof study and the method of comparision, this paper first answers the reason why telecommunication regulatory exists and the necessity, and though the introduction of tow countries' telecommunication regulatory system, points out the differences, and analyses the reason of differences, then, estimates the advantage and disadvantage of both, and based upon these reasons, advantages and disadvantages, givern the situation of China including history and phases, put forward the shortcomings, road of transformation in Chinese telecommunication regulatory system.This paper holds that, at this stage, in the condition of correctly handling of the government's administrative functions and telecommunication regulatory functions, setting different independent regulatory bodies in different stage, and sufficiently pefecting jurisprudence, can form the ideal telecommunication regulatory system which is adapt the situation of China, satisfies the request from regulation and market efficiency.
