Water resources have great significance for human society, it is not only the essential natural resources, but also a very important strategic economic resources. Its double characteristics of natural resources and economic resources determine its double value for human society. Nowadays, in every corner of the world there are different degrees of water scarcity problems. With the rapid development of social economy, these problems become more and more serious, the sustainable development of the global society and economy are largely influenced by the deterioration of water environment and the water scarcity problem. Therefore, we should establish a set of adaptive mechanism of water resources management of our country water regime as soon as possible, in order to effectively promote sustainable utilization of water resources and sustainable development of our society. The theory of water resources optimal allocation is a scientific theory in this background to effectively promote the rational utilization, optimized utilization and comprehensive protection of the water resources. In the scientific guidance and technical support of this theory, establishing the legal system of paid use of water resources is a good way to reduce water wastage, to solve the contradiction between supply and demand of water resources, and it is a effective economic lever to promote the optimal allocation and dynamic balance of water resources. The establishment of such a resource management system is not only conducive to the sustainable use of natural resources, but also to some extent to promote the economical use of natural resources and rational development, it is helpful; to raise funds for research of new resources, and promote the restoration and protection of natural resources. In order to adapts to the situation of China,building the system of water resources allocation is a good way to promote the implementation of compensation for the use of water resources, so we need to have a further study about the theory and practice of the system. This mechanism is mainly based on the optimization disposition of water resources theory and water rights theory, but in practice, the legislation and regulations of water resources protection still have many problems because our water resources protection system started relatively late, especially the reasonable establishment of the paid use system of water resources in law has a lot to do.In this paper, based on the need to China’s current national conditions, water conditions and the establishment of the socialist market economic system, and under the scientific guidance of optimization allocation theory of water resources, based on the further analysis of China’s current water resources paid use legal system, combined with the advanced theory and practice experience of the system of paid use of water resources in foreign countries, and take example of paid use systems of other resources in our country. Aiming at the exposed problems and deficiencies in the our country’s legal system of paid use of water resources, improving the legislative framework and the related institution system of paid use of water resources in China’s, and accelerate the pace of the construction of paid use system of water resources in China, can effectively promote the construction of legal system and protection mechanism of water resources to be more standard, and can maximize the benefit of implementation of paid use system of water resources. In order to fully expedite the rational development of water resources and saving protection in our country, to maintain the ecological balance of the water environment and to achieve a win-win situation between the economic development in society and the protection of ecological environment.
