Developed transport makes people around the world contact more closely, which leading alien species intentionally or unintentionally brought into another country. In the sight of the world’s frequent invasions of alien species, unnatural biological exchanges change the local ecosystem structure, destruct ecosystem as well as biodiversity, and cause serious economic losses. Our country has not developed a specialized law to combat invasive alien species, and the related laws and regulations are fragmented. Furthermore, the legislative intent is backward, the range of legal regulation is limited, and the administrative authorities’power is not clear. China even hasn’t yet established comprehensive management measures, such as prevention, tracking and monitoring, early warning, control, eradication and so on. Convention on Biological Diversity and its guiding principles provide a legal reference for nations to prevent and control invasive alien species. New Zealand, the United States, Japan and Australia which seriously invaded by alien species, are plenty of species and develop trade rapidly. The four countries all enact and amend the relevant laws, so the legal institutions are relatively perfect. Through furnishing the relevant literatures, the article analyses and compares the four typical countries’ legal institutions’from four angles as legislative mode, legislative purpose, management system and specific executive regulations. Based on analyzing their legal advantages as well as disadvantages, and combining with our counties’ current circumstances and specific legislative practice, we can sum up Chinese legal institutions to combat invasive alien species.
