Privacy Right Protection In The Utilization Of The Unopened Archives

With the information being open into the public, the citizen's voice of knowing well and taking use of that information has became intensively. And there is lots of information which are closely related to the citizen's lives in the unopened archives. However, the contradiction, which is caused by the utilization of the archives and protecting people's privacy right, has appeared to be an urgent problem. To analyze the above contradiction, this article,based on the introduction of privacy right and the unopened archives, will research both in the utilization of individual or institutions and the publicating and supplying use archives of archival departments to discuss the responsible principal which are possibly related to the tort. In the final, the article focuses on the conflicts between the right of privacy and people's right of learn to know and the appearances of the conflicts. Also, the chapter gives some protecting solutions, such as the principle of social and public interest, principle of right coordination, principle of personality dignity, and restriction of the social moral.
