Today, we are going to develop our country in the spirit of Rule of Law. The freedom of mass media and judicial justice are two of the most precious values in a Legal State. As a kind of special and independent power in constitutional government system, the mass media play a very crucial role of the propaganda and supervision of a Legal State, and promoting the judicial fair and suppressing judicial corruption. So, in theory, the should encourage and promote mutually, if mass media goes properly, it should exert the function of preventing the realization of judicial justice as well as safeguarding the right of parties to a proper and impartial trial. However, the conflict of intrinsic value between freedom of mass media and judicial independence might cause tension and conflict of these two sides inevitably in some specific conditions. If the supervision of mass media to judiciary is too much, not only the prestige of judiciary will be lowered, but also the right of parties mentioned above will be spoiled so that justice realization will be prevented. Therefore, in practice, the relations between the two values have two different sides. This article will review the development of the idea of Legal State, discuss the relations mentioned above, analysis the nature reasons of conflict between mass media and judiciary in China and point out that they are not contrary in nature, but the relationship of unity of opposites in which harmony and conflict coexist. And we should now pay more attention to supervision of mass media and make this work under rule of law.
