On The Legal Protection Of Equal Opportunities To Higher Education In China

Equalization of opportunities for higher education is the means to achieve social equity and justice. How to solve effectively is the problem that education legislation and education policies have to face . Problems will eventually be involved in legislative and policy issues, because many inequality problems in the field of education, caused by missing or incomplete of the system of laws and regulations , therefore, research on the legal protection has become a basic solve to the problem .From the perspective of law this article is divided into five chapters. The first chapter is an introduction, first of all evoke questions, and the definition of the concept of equalization of opportunities for higher education , and domestic and international literature review and clarify the research method and research significance. Chapter II, from the educational rights of the legal relationship between the main relationship, equal access to education and equal educational opportunities for interpretation of the three dimensions of equal opportunities for higher education legal connotations. The third chapter discusses the current stage of the inequal opportunities for higher education mainly as follows: regional differences, urban-rural differences , gender differences , the performance of social stratification. Chapter IV of higher education in the equal opportunity for analysis. Normative analysis include: our constitution and international conventions and laws on education-related analysis of the opportunities of higher education enrollment. Empirical analysis include: higher education was uneven distribution of resources, regional differences in college enrollment policy significantly, higher education funding policies and the absence of inadequate funding for basic education and the unequal accumulation of power in the college enrollment alienation admissions process. The fifth chapter is the most important part of the article, put forward to achieve equal opportunities in higher education in the specific recommendations,including establish the basic concept of the rule of law, building legislation to protect and strengthen Chief Security and improve Remedies four dimensions.
