At present, our country although there has been some on promoting college students' employment, safeguard employment rights and interests the legal system can depend on, also have scholars and experts of university students' employment law problem of further research. But in reality the countermeasures to promote students employment main or administrative measures, research is also predominantly alone in the macro or micro aspect. Even many people believe that college students employment difficulty lies in the university of enrollment expansion, this is actually no legal and social basis. University graduates and the student employment law protection system lacks have essential relationship. In recent years, China has established including college students, laborer law protection system. Important labor law have "labor law", "labor contract law", "labor dispute mediation and arbitration law", "employment promotion law", "the occupational disease prevention", "the production safety law", "labor law", etc. Important labor laws have "byelaw of inductrial injury insurance", "unemployed insurance byelaw", "social insurance premium collects pay temporary regulations", etc. Still a large number of labor relations and other relevant laws, regulations and rules, judicial interpretation, etc. In the modern society ruled by law and under the conditions of market economy, promoting the employment of college graduates administrative measures role inevitable is very limited. In addition, the employment of college graduates lack of complete management system of social security and safeguard low level, college students employment of socialization service system is not perfect and service level is low, as a long-term mechanism of legal system has a lot of deficiencies. In order to cope with the severe employment situation, promote adapt to market economy conditions of Labour market development, effectively protect students' right to employment, it is necessary to perfect promoting the employment of college graduates of legislation, strengthen promoting the employment of college graduates of specific legal countermeasures.With legal safeguard employment law, promote the university students' employment shall, taking the democracy and the rule of law as the guidance. Establish universities, government, business linkage of college students' employment mechanism and set up their own governance, mutual coordination of harmonious employment system, and realize the talent supply and social demand docking, promoting college students' employment smoothly. Establish anti-discrimination employment law system, college graduates in the social security law, perfect college graduates employment service system legal system.A lot of college students' employment law research of the problem only involves graduate employment should know the common sense. No from the macro and micro legal direction the specific law enforcement to grasp the employment situation.
