The feminist jurisprudence came into being in the 1970's. The women's movement and feminist legal theory had deep effect on it. There were three waves of women's movement, which provided rich experiences for the feminist jurisprudence.The research about women's equality of employment in chapter legal field have been more and more. But they are almost the same research from legislation and practice. The foundation of destroying women's equality of employment is not deeply played attention. Sign from a larger scale, we should consider the more profound questions about women's equality of employment. The feminist legal theory provides a new methodology research about it .So the writer gives up the common way ,and try her best to seek a new view of feminist legal theory to reconstruct the foundation of women's equality of employment. It aims to deny gender difference between male and female.Through the research on the view of feminist legal theory, we can have a conclusion. We want to construct women's equality of employment, not on the base of sex and the feminist particularity. We intend to set up our own theoretical construction and our own legal strategy on this gender and difference sure after examining all above feminist legal theories with careful but challenging eyes.After perceiving the foundation of women's inequality of employment over again , we can reform and consummate the measure of protecting women's equality of employment easily.
