Human rights, by definition, are people's rights."Human rights"is a historical category. The bourgeoisie struggled against the feudal authoritarianism as"human rights"as the flag and made its own claim, which is progress in history. However, the claim is the abstract and could not adapt to the needs of the times. Human rights are one of the major issues in modern society .Human rights relates to human development itself and contemporary social and political closely. Therefore, studying the philosophic- al foundation of human rights and Marxism human rights outlook are extremely important.The study of human rights is under the background of rising of humanism. In the broad sense, the study of human rights is one part of the human study. People learn to be resolved is the people's basic problems, such as nature and so on. This is provided for in-depth understanding of the theoretic. Understanding of human rights is how to produce, develop, research and why human rights are very necessary.After years of the development of human rights theory, theorists recognize that the human rights advocates is to the preservation of human dignity, promote human development and achieve the liberation. In ancient China, for a fairly long period of time, people do not have human dignity, not to speak of rights. In modern society, and people's rights awareness increased, and China's economic development has been rapid, politically, the state establish a"people-oriented scientific development concept"and the"respect and protection of human rights"in the Constitution, which provided a better external environment for universal human rights.
