The Construction Of Juvenile Offenders Probation System

Facing a problem that juvenile delinquency become more and more serious, we need to take probation as an effective penalty measure to promote the education and correction for juvenile offenders, to prevent and reduce juvenile crime as well. However, China's probation system for juvenile offenders makes no distinction between adult offenders and juvenile offenders, which has many shortcomings in the application of probation of juvenile offenders, such as unreasonable applicable standards, single probation type, unprofessional regulatory system and so on; it cannot make full use of the advantages of probation to correct and educate juvenile offenders, to achieve the purpose of punishment. In the basis of theory with practice, this thesis would adopt methodology of historical research, comparative research, analytical inductive research, empirical research and so on. Given that the particularity of juvenile delinquency, and in the basis of some theoretical guidance of the juvenile offenders probation, such as the penalty modesty, the penalty humanitarian, the combination of punishment and education, to generalize the value and importance of the probation application of juvenile offenders, and put forward some suggestion on building juvenile offender probation system on the diverse the probation type, relaxing application standards, establishing regulatory structures and so on.
