Study On The Law Of Water-Saving Of China

Water is the source of life, not only an integral part of living matter, but also the medium and carrier. Water is also a natural resource, but a scarcity resource, the basic elements of economic and social development. China is a developing country. In the planned economy era, the water resources, which had been considered to be invaluable in a long term, were distributed as a plan. So this distribution caused serious abuse and waste of water resources, its influence still exists until now. At present, water resources condition was worth the anxiety, water shortage has become a bottleneck, which restricts our country economic development. The root of the problem of China's water resources is not the lack of engineering technology measures, but the one of law and the relevant system,which was related to promote water conservation, pollution controlling and others, it is high efficiency, excellent technology and large-scale application. Legal system played a fundamental, overall, stability and long-term role. Therefore, in order to regulate people's development and use of water resources, maintain the water balance in the ecosystem, we must build a scientific and reasonable water-saving legal system. From the legal angle of view, this article attempts to explore new approaches and new methods for water conservation. In order to solve the increasingly serious problem of water resources, we have an urgent need for legal innovation.Based on the importance of water resources and the existing problems in the socio-economic life, this article analyzes the shortage of protection from a legal point of view. Firstly, says China's current situation of water resources, pointes out that the shortage question of water resources is prominent, the waste phenomenon and the water pollution question are very serious, then the necessity to study China's water-saving law. Secondly, in the aspects of China's water-saving, there are many problems , the use of economic means is not full, the ownership of water resources is not clear, the system of water-saving laws is not complete, rural water-saving legislation is despised, Compared with the urban legislation ,it is known to all that other countries'experiences could be models. So I compared the different water-saving legal systems of United States, Japan, Israel and other countries, to made a legal innovation of the Chinese water-saving law, wish to have an important guiding to our country's saving water legal regime.In order to improve China's legal system of water-saving, this article establishes the guiding ideology and basic principles of water-saving legal system. Finally, we should develop "Water-Saving Law", establish national and local water conservation planning, speed up the watershed legislation, improve the existing water-saving laws and regulations'supporting construction and standard work and properly handle cross-cutting between the laws. Establish and improve the relevant supporting of the legal system. Under the sustainable development thought's instruction, considered the humanist principle as an idea, we should set up through the improvement of water rights and trading system, water licensing system, the paid use system, incentives and responsibility system and so on. Incentive and expect the external environment and water resources scientifically ,guide the public to use of limited water resources rationally and efficiently, and eventually realize the objective of saving water.
